NEXUS LETTERS

I have a question. When the doctors write these nexus letters..after the diagnosis, treatments, etc...is it a must that it contain the phrase.."more likely than not"..is that the
wording that the VA is looking for?..i spoke to John yesterday via phone and want to thank him for the insight, thanks john..i go for my appt. next week, actually the 18th and my dr.
would like to know what he is writing..this should carry some weight i hope he is a prof. at Harvard med school...is it possible that some doors have been opened and the culture is changing?..is the VA going to start approving these...any help or ideas for the letter, how to draft etc..pls let me know..thanks

If you guys will send me your private email address', I will send you an actual Nexus letter which achieved 100% disability for a Camp Lejeune veteran. We are trying to load these to the site for everyones benefit but it's going a little slow......Jerry Ensminger

Go to this site and it has everything on how to file a claim. Jim Strickland is very experienced and other vets on the site have been through and seen it all for the most part. They've been at this for quite a while. Jim was with vawatchdog.org but that site is closing and Jim has taken things over with the today site. If you don't find an answer to a question just ask. You will get a accurate response with no bull.
And to the person asking about "at least as likely as not", absolutely this is what the DVA wants to see. This is the minimum 50/50 and benefit of doubt goes to the veteran.
Also there's a Dr. Bush I used, he's in Georgia. He did an excellent job on my IME. And he was very reasonable.
By using Jims site and asking questions I was able to get 40% sc. Before that the VSO's and lawyers got me nothing. But mine was a tough case. Now with Dr Bush's IME and from using the site I'm working on 100% sc.
TCE is only a part of my case and I was exposed on Guam and at Hunters Point Naval Shipyard.

NEXUS Letter Doc @ a good price.

Doctor Bill Denis is providing NEXUS letters for $1500. I feel this is a good price. He charges 250.00 for the initial Independent Medical Records Exam. (IMRE) Then if your case has merrit, and the documentation is in order he is able to complet the task for 1250. He can be reached @ dennisw1201@mac.com. He provided a great letter for me, and has been thoughtful and considerate as well. He is very thorough.

I believe he will be helpful to many on this board, and can save you a lot of money for the IMRE. He is a veteran and served in Iraq. He will help you out.

Try to send him an e-mail first. He will respond. He will tell you to send your medical records. He likes CD which you can get from Release of Information at the VA. Just Send Bill and E-mail. My email is larry.pearson.norfolk@hotmail.com

VA Review

All,

Last week I inquired with my Congressional office here in Pasco Co, FL about the status of my claim. It had been a year + since I had received any word. Today I recieved an answer from my Congressmans aide, we will call her Ms.B. She made an inquiry of my case with the VA in Lousville and was informed of the.

My claim was established in Tampa, FL on Sept 10, 2010 ( diagnosed with CLL on July 27, 2010). It sat on someone desk for 8 months before it was reviewed and determined to be a CL water issue. On May 10, 2011 it was recieved in Lousville. The reason given for the 8 month delay was " an issue with Camp Lejeune". The email response also reads "other regional offices have submitted claims in January 2011 and they have yet to be reviewed" it continues and reads " most claims take 1-1 1/2 years to review, but the CL issue will require longer due to the overwhelming investigative process".

Is this the norm ? I now truly believe that the VA is uncaring of veterans in general. The fact that my file sat for 8 months on someones desk is CRIMINAL. The tone of the respondant eg: overwhelming, is a clear indication that the attitude is "wait your turn, we will get to it someday". Simply put, there is no sence of urgency on behalf of these pencil pushing governement pukes. PEOPLE ARE DYING and some of them may have their files sitting on some jerks desk right now. I also loved the closing points that my congressional aide added. " we are sorry for the delay in processing your claim, we are doing all we can on your behalf" it continues, "if you would like us to close our investigation on your behalf so that you could direct your future concerns to your U.S Senator we will" continues " if so, we must CLOSE you case and you would be required to establish a new case becasuse "THEY DONT LIKE TO HAVE 2 OFFICES WORKING ON ONE CASE" . Well lady, I DONT LIKE walking around knowing that I have a cancer in my body that slowly and surely killing me. This is simply all BULLSH_T.

My case is just one and to date I am fairly healthy (stage 1). But for the guys I read about on this forum that are just hanging on it really pisses me off. How many Marines or dependants will die in the 8 months that a file sits on a desk. if the task is overwhelming then bring on more support. And lastly, what is more overwhelming than dealing with a loved one that is critically ill from drinking the so called life sustaining water they provided.

It is the norm for a case to take 18 months or longer, yes. However, the Tampa Office should not have had your file lying on some desk for eight months. You can file a complaint with the central office, if you want to, but chances are that nothing will really ever happen to the person who held on to your folder for those months.

You certainly have the right to ask a congress person or senator to check on the status of your claim. The VA is not going to like it, but they can not do anything about it either. In the end, though, you will end up having to go through the process just like every other veteran and it will take time. Especially now that the government is looking for places to cut staffing costs and other funding to programs like the VA.

There is no doubt that many veterans will die before they win their claims with the VA. The only way for that to change is to spend a good deal more money on staff training and also increase staffing levels. Not likely in today's government.
